Terms and Conditions

1. Scope

These terms and conditions apply to all orders placed through our online shop and to all contracts, deliveries, and services provided by HABICO Künstlerpinselfabrik Bieringer GmbH. We do not recognize any differing terms and conditions of the customer unless we have expressly agreed to them in writing.

 

2. Conclusion of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
By clicking the "Buy now" button, you are placing a binding order for the goods in your shopping cart. The purchase agreement is concluded as soon as we accept your order by sending an order confirmation via email or by shipping the goods.

 

3. Right of withdrawal

Consumers have a statutory right of withdrawal in accordance with Sections 312g and 355 of the German Civil Code (BGB). Details can be found in our cancellation policy, which forms part of these terms and conditions.

 

4. Delivery times

Unless otherwise stated, delivery takes place within 3 to 5 business days after receipt of payment. Delivery times may vary for international shipments. Should we be unable to deliver an item on time, we will inform you immediately.

 

5. Prices, shipping costs and payment

All prices are in euros and include VAT.

  • Shipping costs:

    • Germany: We offer free shipping on orders over €30.00. For orders below this amount, we charge a flat shipping fee of €6.00.

    • EU countries: Shipping costs are displayed during the ordering process and depend on the destination country.

    • Non-EU countries: In addition to shipping costs, customs duties, taxes, or other charges may apply, over which we have no control. These are the responsibility of the buyer.

  • Payment options: In our online shop, we offer the payment methods displayed during the ordering process (PayPal, prepayment, creadit cards).

The risk of accidental loss or damage to the goods passes to the buyer upon handover to the shipping provider (e.g., DHL). We will take out transport insurance.

 

6. Retention of title

The goods remain our property until full payment is received.

 

7. Warranty

The statutory warranty applies. Please note that predominantly natural materials are used in the manufacturing process. Therefore, variations in color or texture compared to the images do not constitute a defect, provided that the intended use is not impaired.

Please report any obvious transport damage immediately to the delivery person and to us. Consumers do not lose their statutory warranty rights by failing to report such damage. Commercial customers must comply with the inspection and notification obligations according to Sections 377 and 378 of the German Commercial Code (HGB).

 

8. Liability

Claims for damages are excluded unless caused by intent or gross negligence. Liability under the Product Liability Act remains unaffected.

 

9. Data protection

We process personal data exclusively in accordance with the provisions of the GDPR. Details can be found in our privacy policy.

 

10. Links to external websites

Our website contains links to external websites of third parties, over whose content we have no control. We therefore assume no liability for this external content. The respective provider or operator of the linked pages is always responsible for their content. At the time the links were created, the linked pages were checked for possible legal violations; no illegal content was found. Continuous monitoring of the content of linked pages is not reasonable without concrete evidence of wrongdoing. Upon notification of legal violations, we will remove such links immediately.

 

11. Place of performance and jurisdiction

The place of performance for all services is our registered office.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Ansbach.

 

12. Applicable Law

German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
